MindMath SA (the "Service") is operated by MindMath SA ("MindMath SA", "we", "us", "our"), a company registered in the Republic of South Africa. By creating an account, accessing, or using the Service, you ("you", "the user") agree to these Terms & Conditions.
1. Acceptance
By signing up for or continuing to use MindMath SA, you confirm that you have read, understood, and agreed to be bound by these Terms. If you are under 18, your parent or legal guardian must agree on your behalf. If you are using the Service on behalf of a school or organisation, you confirm you have authority to bind that entity.
2. The Service
MindMath SA is a CAPS-aligned online learning platform for South African learners in Grades 7–12, offering lessons, adaptive practice, an AI maths coach, a homework scanner, and progress tracking for Mathematics and Mathematical Literacy. MindMath SA is independently developed and is not affiliated with, endorsed by, or approved by the Department of Basic Education.
3. Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account.
- You must notify us immediately of any unauthorised access.
4. Acceptable use
You must not:
- Use the Service for any unlawful purpose, fraud, or to harass others.
- Infringe any intellectual property rights, including by uploading content you do not own or have licence to upload.
- Attempt to interfere with the Service's security, including probing, scanning, scraping, or introducing malware.
- Resell, redistribute, reverse engineer, or circumvent technical limits of the Service.
- Use the Service to generate content that is illegal, hateful, defamatory, or sexually explicit.
5. Intellectual property
The Service, including all software, content, branding, lesson material, and the "MindMath SA" name and logo, is owned by MindMath SA and protected by South African and international copyright and trademark law. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal educational purposes within the subscription tier you have selected. See our Content Sourcing Policy for how our educational content is created.
6. User content
You retain ownership of content you upload (e.g. homework scans). You grant us a limited, worldwide, non-exclusive licence to host, process, and display that content solely to provide the Service to you. We do not use your uploads to train AI models or to seed our public content library.
7. AI features
The AI Maths Coach and Homework Scanner generate explanations automatically and may occasionally be inaccurate or incomplete. Outputs are intended as study aids, not as a replacement for a qualified teacher, and should not be used for regulated professional advice. You are responsible for verifying answers before submitting them as your own work. You must not use the AI features to generate non-mathematical content or content that violates section 4.
8. Subscriptions, payments, and refunds
Paid plans (Premium, Parent Pack) are billed monthly or annually. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.
9. Free tier limits
The free tier includes daily limits on AI Coach messages and homework scans. We may change these limits at any time. Premium subscribers receive generous fair-use limits designed to prevent abuse and protect service quality.
10. Service availability
We aim to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may suspend, modify, or discontinue features with reasonable notice.
11. Suspension and termination
We may suspend or terminate your account, with or without notice, for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time from your profile settings.
12. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Our aggregate liability to you for any claim arising from the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, gross negligence, death, or personal injury where such exclusion is prohibited by law.
13. Indemnity
You agree to indemnify MindMath SA against claims arising from your user content, your use of the Service in breach of these Terms, or your violation of applicable law.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa, without prejudice to your statutory consumer rights.
